The Nevada Foreclosure Mediation Program in Clark County

Fox, Imes & Crosby, LLC was among the first firms in Las Vegas to participate in the Nevada Foreclosure Mediation Program. In Clark County, the program is administered by the Eighth Judicial District Court’s Alternative Dispute Resolution Department. Since September 1, 2017, eligible homeowners have been able to petition for mediation as a structured alternative to allowing foreclosure to proceed unchallenged.

Eligibility & Timeline

To participate, a homeowner must file a Petition for Foreclosure Mediation with the District Court within 30 days of receiving a Notice of Default on a primary owner-occupied residence. The ADR Office assigns a mediator within 10 days of an Answer being filed, and mediation must be conducted within 90 days of that assignment. Homeowners with an open bankruptcy proceeding aren’t eligible. Under Nevada law, a Certificate from Home Means Nevada must be recorded before a trustee’s sale can proceed on any owner-occupied property.

Nevada’s nonjudicial foreclosure process, governed by NRS 107.080, can run four months or more from Notice of Default to trustee’s sale, though active mediation or documentation disputes can extend that timeline significantly. Under federal law, a mortgage servicer can’t officially begin foreclosure until payments are at least 120 days past due. The lender must deliver the Notice of Default by registered or certified mail, post a copy on the property, and record it with the Clark County Recorder.

If a homeowner waives or doesn’t participate in mediation, Home Means Nevada issues a Certificate of Foreclosure approximately 60 to 90 days after service of the Notice of Default, allowing the trustee to proceed. After a sale concludes, lenders generally have only six months to pursue a deficiency judgment under NRS 40.455, and the recoverable amount is capped at the lesser of the difference between the debt and the property’s fair market value or the difference between the debt and the actual sale price.
